Terms of Service

Please read these terms carefully before using Dezite

1. Introduction

Welcome to Dezite ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Dezite website builder platform, including all related services, features, and content (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. When you make a purchase, you are buying from Paddle, who then grants you a license to use our Service. All payment processing, invoicing, tax calculation, and receipt delivery are handled by Paddle on our behalf.

3. Description of Service

Dezite is a website builder platform that allows users to create, customize, and publish websites using professionally designed templates. The Service includes:

  • Template-based website creation and editing
  • Website hosting on Cloudflare's global network
  • Custom domain support
  • Optional add-on services (Analytics, Blog, Testimonials, Newsletter, Community Management, and others)
  • A content editing interface for managing your website

4. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activity under your account

You must be at least 18 years old to create an account.

5. Free Trial

We offer a 14-day free trial with no credit card required. During the trial period, you have full access to template editing and site preview. After the trial period expires, a 3-day grace period is provided. After the grace period, you must subscribe to a paid plan to continue editing and publishing your site.

One trial is available per site. Trials cannot be extended or renewed.

6. Subscriptions and Billing

6.1 Subscription Plans

The Service is offered on a subscription basis with monthly and annual billing options. Annual billing provides a 50% discount compared to monthly pricing. All billing is processed by Paddle as our Merchant of Record.

6.2 Auto-Renewal

Auto-renewal is OFF by default for all plans. You must explicitly opt in to automatic renewal. If auto-renewal is not enabled, your subscription will expire at the end of the current billing period.

6.3 Price Changes

We may change subscription prices from time to time. Monthly subscribers will be notified 30 days before any price change takes effect. Annual subscribers are locked at their committed rate for the remainder of their annual term.

6.4 Add-On Services

Optional add-on services (such as Analytics, Blog, Newsletter, Testimonials, and Community Management) can be toggled on or off at any time. Each add-on is billed as a separate subscription item through Paddle. Proration for mid-cycle changes is handled automatically by Paddle.

7. Pause Mode

You may temporarily pause your website instead of canceling. During pause mode:

  • A maintenance fee of $1/month (or $12/year on annual billing) applies
  • Your site goes offline and is not publicly accessible
  • All data is preserved
  • Template editing and add-on services are suspended
  • Maximum pause duration is 30 days
  • You may reactivate at any time to resume your previous plan

8. Cancellation

You may cancel your subscription at any time through your dashboard billing settings or by contacting support@dezite.com. Upon cancellation:

  • You retain access to your site until the end of the current billing period
  • No refunds are issued for the remaining period (see our Refund Policy)
  • After the billing period ends, your site will no longer be publicly accessible
  • Your data will be retained for a reasonable period to allow reactivation

9. Content Ownership and Intellectual Property

9.1 Your Content

You retain full ownership of all content you create, upload, or publish through the Service ("Your Content"). We do not claim any ownership rights over Your Content.

9.2 Our Platform

The Service, including all templates, software, design elements, and underlying technology, is owned by us and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9.3 License to Us

By using the Service, you grant us a limited license to host, store, and display Your Content solely for the purpose of operating and providing the Service to you.

10. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Publish illegal, harmful, threatening, abusive, or defamatory content
  • Distribute malware, viruses, or other harmful code
  • Send spam or unsolicited communications
  • Infringe on the intellectual property rights of others
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Engage in any activity that disrupts or interferes with the Service

We reserve the right to suspend or terminate accounts that violate these terms.

11. Third-Party Services

The Service integrates with third-party providers for certain functionality. Your use of these integrations is subject to the respective third party's terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

12. Limitation of Liability

To the maximum extent permitted by law, Dezite and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us (via Paddle) in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

14. Indemnification

You agree to indemnify and hold harmless Dezite and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

15. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
